Just as feedback for others interested:

After extensive testing by @lafondelgat it seems the waveshare35b-v2 overlay currently does not work with kernel 5.10. A cross-comparison with Raspberry Pi OS confirmed this. The overlay is working on Volumio 2 (kernel 4.19).
